How much notice must a tenant give to end a month-to-month or week-to-week tenancy?

Short answer

In Newfoundland and Labrador a tenant must give written notice at least one month before the end of a rental period for a month-to-month tenancy, or 7 days before the end of a rental period for week-to-week (s.18(1)).

For a month-to-month tenancy, the tenant gives notice not less than one month before the end of a rental period; for a week-to-week tenancy, not less than 7 days before the end of a rental period (s.18(1)(a)–(b)). The notice must be given no later than the first day of a rental period and must state a termination date that is the last day of a rental period (s.18(9)(b)–(c)). It must be in writing on the form prescribed by the minister, signed, addressed to the landlord, identify the premises and state the section it is given under (s.34, s.18(9)(a)), and be served on the landlord by a method in section 35. No notice is needed where the landlord and tenant agree in writing to end the tenancy on a specific date (s.18(5)), and they may agree in writing to a longer notice period (s.18(6)). A tenant who has received the landlord's notice to terminate and wants to leave sooner still gives the tenant's notice (s.18(7)). On a fixed term, the tenant's notice is not less than 2 months before the end of the term (s.18(1)(c)).
