The rules it applies

  • Standard notice, no reason needed (s.18(2)): 3 months for month to month and 4 weeks for week to week, ending on the last day of a rental period; for a fixed term, 3 months before the term ends.
  • Rent not paid (s.19(1)): once rent is 5 days overdue (3 week to week), a notice of not less than 10 days (3 week to week). Paying everything owed before the date cancels it, except a third notice in 12 months.
  • The periods count from when the notice is served: registered mail counts as served on the 5th day after mailing (s.35(5)); email sent after 4 p.m. counts as served the next day that is not a Saturday or holiday (s.35(6)).
  • A notice has to be on the official form. If the tenant does not leave, only an order from the Director, enforced by the sheriff, can make them go.
